Effective Date: 1 March 2025
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("the Student", "you" or "your") and Jebellar Academy (CRICOS Provider Code 02644C), operating the website jebellar.com ("the Website"). By accessing the Website, submitting an enrolment application or participating in any course delivered by Jebellar Academy, you agree to be bound by these Terms in their entirety. If you do not agree with any provision of these Terms, you must discontinue use of the Website and refrain from enrolling in any programme.
Enrolment in Jebellar Academy courses is open to individuals aged 18 years or older. Applicants aged between 16 and 17 may be accepted with the written consent of a parent or legal guardian and subject to appropriate welfare arrangements being in place in accordance with Standard 5 of the National Code 2018. All international students must hold a valid student visa (subclass 500) or other visa that permits full-time study in Australia. Jebellar Academy reserves the right to decline any application at its sole discretion.
To complete enrolment, you must submit a signed enrolment application form together with certified copies of your passport, evidence of English language proficiency (where required), academic transcripts and proof of Overseas Student Health Cover (OSHC) for the duration of your intended study period. Jebellar Academy may request additional documentation depending on the course and your individual circumstances.
Enrolment is confirmed only upon Jebellar Academy's issuance of a written Letter of Offer and, for student visa holders, a Confirmation of Enrolment (CoE). A CoE will be issued after the required tuition fees and any applicable deposits have been received. The issuance of a Letter of Offer does not guarantee the subsequent issuance of a CoE, which remains contingent on payment and the satisfaction of all entry requirements.
All tuition fees, material fees and other charges are published on the Website and in the Letter of Offer. Fees are quoted in Australian dollars and are subject to annual review. Jebellar Academy will not increase tuition fees for the duration of your enrolled course once payment has been made and a CoE has been issued. Payment may be made by bank transfer, credit card or other methods specified at the time of enrolment. Failure to pay fees by the due date may result in cancellation of your enrolment.
As a student of Jebellar Academy, you agree to the following obligations:
Jebellar Academy monitors student attendance systematically in accordance with the National Code 2018. Students who are at risk of falling below the 80% attendance threshold will be contacted in writing and offered intervention support. Continued failure to meet attendance requirements, without an approved leave of absence or compelling and compassionate circumstances, may result in the reporting of a student visa breach to the Department of Home Affairs. Jebellar Academy will afford all students procedural fairness before any such report is made, including an opportunity to access the institution's internal complaints and appeals process.
All content published on jebellar.com, including but not limited to text, graphics, logos, images, audio, video, course materials and software, is the intellectual property of Jebellar Academy or its licensors and is protected by Australian and international copyright, trade mark and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the Website and any course materials provided to you solely for your personal educational purposes. You agree to use jebellar.com solely for lawful purposes and in a manner consistent with these Terms. You must not use the Website in any way that could damage, disable, overburden or impair the server infrastructure; attempt to gain unauthorised access to any part of the Website, its servers or any connected systems; introduce any virus, trojan, worm or other malicious code; or use automated scripts, bots or scrapers to extract data from the Website. Jebellar Academy reserves the right to restrict or terminate your access to the Website without notice if you breach any of these provisions.
To the maximum extent permitted by law, Jebellar Academy excludes all liability for any indirect, incidental, special, consequential or punitive damages arising out of or in connection with your use of the Website, your enrolment or your participation in any course. This includes, without limitation, damages for loss of profits, data, goodwill or other intangible losses, even if Jebellar Academy has been advised of the possibility of such damages. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Australian consumer law.
These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales and any courts of appeal therefrom for the resolution of any dispute arising under or in connection with these Terms. Nothing in these Terms restricts the operation of the Education Services for Overseas Students Act 2000 (Cth) or the right of a student to pursue any remedy available under that Act.
Jebellar Academy is committed to resolving disputes in a fair and timely manner. In the event that a dispute arises between you and Jebellar Academy, the following process applies. You should first raise the matter informally with your course coordinator or student services officer. If the matter remains unresolved, you may submit a formal written complaint to Jebellar Academy's Complaints and Appeals Officer at info@jebellar.com. A written response will be provided within twenty (20) business days. If you are dissatisfied with the outcome, you may seek external review through the Overseas Students Ombudsman at no cost.
Jebellar Academy reserves the right to modify these Terms at any time. Changes will be published on this page with an updated effective date. Material changes will be communicated to enrolled students via their registered email address at least fourteen (14) days before taking effect. Your continued use of the Website or participation in a course following the publication of amended Terms constitutes your acceptance of those amendments.
